Are there sales tax on a wedding cake in New York State? :unsure:

Welcome to the forums. Those picked up from a grocer or bakery are not subject to sales tax.
You will only pay sales tax if they include utensils as part of the price for the wedding cake.
Wedding cakes sold and served by a caterer are unfortunately taxable as prepared foods.

Hey! What happens if you are a caterer and do not collect sales tax to keep it cheap?

Eventually, the business would get audited and would also be on the hook for the difference.
If you are selling wedding cakes from your dwelling, that does not make taxable sales.

You could bake your own but your caterer might charge you for serving the cake to your guests. ;)
